FISA Court Shamefully Protects the Swamp

Your editorial “A Pass for Kevin Clinesmith” (Jan. 30)—condemning the slap on the wrist of former FBI attorney Kevin Clinesmith, who was sentenced only to probation by Obama-appointed Foreign Intelligence Surveillance Court Judge James Boasberg for altering a CIA email to get a surveillance warrant to spy on Trump campaign adviser Carter Page as an example of “two-tiered justice”—It omits a more compelling example than how Gen. Michael Flynn and George Papadopoulos were more harshly treated.

In our filing with Judge Boasberg, we pointed out how attorney Alex van der Zwaan, the first person sentenced in special counsel Robert Mueller’s Russia investigation, also pleaded guilty to one count of making a false statement. D.C. Bar Has Not Acted on NLPC’s Request to Disbar Clinesmith

As the U.S. government seeks prison time for a former FBI lawyer who admitted falsifying evidence to spy on a former Trump aide, the District of Columbia Bar association hasn’t begun an investigation to strip him of his law license, records show.

Carter Page: Ex-FBI lawyer Kevin Clinesmith is still listed as an “active” attorney in “good standing” with the D.C. Bar despite forging a document to win approval to spy on Page.

The defendant, Kevin Eugene Clinesmith, is still listed as an “active” attorney in “good standing” with the Democrat-controlled D.C. Bar, despite his having pleaded guilty more than five months ago to illegally altering a document used for authorization to electronically eavesdrop on former Trump campaign adviser Carter Page as part of the FBI’s Russiagate probe.

Prison Urged for FBI’s Clinesmith Who Forged Evidence Against Carter Page

National Legal and Policy Center (NLPC) has filed a sentencing memorandum with the federal court in Washington, D.C., calling upon Judge James E. Boasberg, who also presides over the secret Foreign Surveillance Intelligence Court (FISC), to sentence former FBI attorney Kevin Clinesmith to prison instead of probation at his public virtual sentencing hearing Friday morning at 11:00 a.m.

NLPC also called upon the judge to require Clinesmith to make a video about his crime and express remorse to be used by the Justice Department for their ethics training program for all DOJ and FBI attorneys.

In an August 14, 2020, plea agreement with Special Counsel John H. Disbarment Sought of FBI’s Kevin Clinesmith Who Altered Email to Trigger Campaign Spying

National Legal and Policy Center (NLPC), an ethics watchdog group, filed a disbarment action today with the D.C. Bar against fired FBI attorney, Kevin E. Clinesmith, who pled guilty to a felony last month for doctoring a CIA email used to support a surveillance warrant against Carter Page, a former Trump campaign foreign policy advisor.

In an August 14, 2020, plea agreement with U.S. Attorney John H. Durham, who was tasked by Attorney General William Barr with investigating the origins of the 2016 Russia collusion probe known as “Crossfire Hurricane,” Kevin Clinesmith admitted that he doctored a June 15, 2017, CIA email by adding that Carter Page, “was not a source” for the CIA in his contacts with Russian sources, when in fact he was a contact with the CIA.
