FISA Court Shamefully Protects the Swamp

This letter to the editor by NLPC Counsel Paul Kamenar appears in the Wall Street Journal today:

Your editorial “A Pass for Kevin Clinesmith” (Jan. 30)—condemning the slap on the wrist of former FBI attorney Kevin Clinesmith, who was sentenced only to probation by Obama-appointed Foreign Intelligence Surveillance Court Judge James Boasberg for altering a CIA email to get a surveillance warrant to spy on Trump campaign adviser Carter Page as an example of “two-tiered justice”—It omits a more compelling example than how Gen. Michael Flynn and George Papadopoulos were more harshly treated.

In our filing with Judge Boasberg, we pointed out how attorney Alex van der Zwaan, the first person sentenced in special counsel Robert Mueller’s Russia investigation, also pleaded guilty to one count of making a false statement. ‘Miscarriage of Justice’ as Clinesmith Gets Slap on the Wrist

Federal Judge James E. Boasberg, who also presides over the secret Foreign Surveillance Intelligence Court (FISC), sentenced former FBI attorney Kevin Clinesmith to probation instead of prison as he had requested at his sentencing hearing this morning.

NLPC filed a sentencing memorandum with the court earlier in the week calling upon the judge to incarcerate Clinesmith The government requested three-to-six month prison sentence. Instead, the judge sentenced him to community service and imposed no fine.

“This was a total miscarriage of justice,” fumed NLPC Counsel Paul Kamenar who attended the hearing.  “Equal justice demanded at least the same sentence for Clinesmith as was given to Alex van der Zaan, and more, since he held a position of trust,” said Kamenar, who drafted the sentencing memorandum.  NLPC also recommended that any probation include requiring Clinesmith to make a video expressing his remorse to be shown to all Department … Read More ➡

As the U.S. government seeks prison time for a former FBI lawyer who admitted falsifying evidence to spy on a former Trump aide, the District of Columbia Bar association hasn’t begun an investigation to strip him of his law license, records show.

Carter Page: Ex-FBI lawyer Kevin Clinesmith is still listed as an “active” attorney in “good standing” with the D.C. Bar despite forging a document to win approval to spy on Page.

The defendant, Kevin Eugene Clinesmith, is still listed as an “active” attorney in “good standing” with the Democrat-controlled D.C. Bar, despite his having pleaded guilty more than five months ago to illegally altering a document used for authorization to electronically eavesdrop on former Trump campaign adviser Carter Page as part of the FBI’s Russiagate probe.

Disbarment Sought of FBI’s Kevin Clinesmith Who Altered Email to Trigger Campaign Spying

National Legal and Policy Center (NLPC), an ethics watchdog group, filed a disbarment action today with the D.C. Bar against fired FBI attorney, Kevin E. Clinesmith, who pled guilty to a felony last month for doctoring a CIA email used to support a surveillance warrant against Carter Page, a former Trump campaign foreign policy advisor.

In an August 14, 2020, plea agreement with U.S. Attorney John H. Durham, who was tasked by Attorney General William Barr with investigating the origins of the 2016 Russia collusion probe known as “Crossfire Hurricane,” Kevin Clinesmith admitted that he doctored a June 15, 2017, CIA email by adding that Carter Page, “was not a source” for the CIA in his contacts with Russian sources, when in fact he was a contact with the CIA.

Special Counsel Needed Because Huber’s ‘Mystery’ Probe Is Going Nowhere

U.S. Attorney John Huber

Fred Lucas in The Daily Signal today reports on the investigation supposedly being conducted by John Huber, the United States Attorney for Utah. Instead of appointing another Special Counsel, then-Attorney General Jeff Sessions a year ago appointed Huber to investigate the FISA warrant issued on Trump campaign aide Carter Page, as well as the Uranium One deal. From the story:

Since his appointment, Huber’s investigation has been a complete mystery, said Peter Flaherty, chairman of the National Legal and Policy Center, a conservative government watchdog group.

“There is no evidence a real investigation is taking place,” Flaherty told The Daily Signal. “We don’t have a grand jury. It doesn’t seem key witnesses were interviewed. There is certainly no evidence he has staffed up. What he is up to is a mystery.”

Fusion GPS Hiring of Nellie Ohr Was Part of Scheme to Influence the Election

Luke Rosiak of the Daily Caller today looks at the employment of Nellie Ohr, wife of Department of Justice (DoJ) official Bruce Ohr, by the political hit-squad firm Fusion GPS under a contract with the Clinton campaign. From the article:

“The financial arrangement between Mrs. Ohr and Fusion GPS gives the appearance of government-for-hire,” said Tom Anderson, an ethics expert at the conservative-leaning watchdog group the National Legal and Policy Center. It “appears to be a sophisticated scheme to get access to the highest levels of our government … ensuring the use of government resources in an attempt to influence an election.”
