Ask Kamenar: Did Sen. Van Hollen Violate the Logan Act?

TRANSCRIPT: “Senator Van Hollen of Maryland went down to El Salvador to visit this MS13 terrorist Kilmar Garcia in the prison down there. He was successful in having a meeting with him. The pictures show that they’re sipping of what may be margaritas, etc. But the question is by going down there in violation of the policy of the United States, in terms of foreign affairs, did Van Hollen violate what’s called the Logan Act of 1798? That act prohibits private citizens from conducting foreign affairs without the approval or the authority of the Federal Government and in contravention, of what the U.S. policy is.

Now, it’s been uh invoked in the past. It’s been used maybe two times, but there was never any conviction and there’s a question whether it may be even constitutional because it impinges on first amendment rights.  Furthermore, it says that you can’t do it as a private citizen. And, I think Van Hollen realized that, and said, “no I’m going down as a senator from Maryland. This man is a resident of my state and I’m there checking on his welfare, et cetera. So, he may have tried to escape the legal confines and constriction of that law.

So, I don’t think, Number one, he may have violated it, the exact terms of it. Number 2, even if he did there will not be any prosecution. However, it should be mentioned, of course, that his going down there and showing sympathy for this MS-XIII gang member that he feels compassion for his plight, yet at the same time he’s showing no compassion for the victims of MS-XIII murderers. I mean victims of the murders by these MS-XIII gangs here in his own state and in the United States. There was the mother of one victim at the White House yesterday who gave her a very sad and tragic story of how her daughter was dragged and killed by these gang members and that Senator Van Hollen didn’t pick up the phone and express any sympathy at all.

So this goes to show you the hypocrisy that’s going on with not only Senator Holland but the Democrat Party as a whole.”
