Are Obama's NLRB Appointments Constitutional?

NLRB logoRepublican objections to President Obama's temporary appointments last week to the National Labor Relations Board (NLRB) haven't been unexpected. The board, by law, must consist of three members of one major party and two of the other. And so long as he remains in the White House, Democrats will enjoy an automatic majority. But at least two appointments may also be unconstitutional, say critics. That's because the president's referrals to the Senate of the two Democratic nominees, Sharon Block and Richard Griffin, were made during a period in which senators were not on official recess.

Top Ten Union Corruption Stories of the Year

Top TenOrganized labor, masters of aggressive politics, had its share of triumphs in 2010. With Democrats, their natural ally, the previous year having taken control of the White House and the Senate while increasing their advantage in the House, this was to be expected. AFL-CIO President Richard Trumka and other union officials used their window of opportunity to pressure Congress into passing a health care overhaul mandating unprecedented degrees of government intrusion, and by extension, major opportunities for unionization of the health care labor force. They also secured key presidential appointments.

Corporations Favor EPA Regulation of Greenhouse Gases

Nike logoEarlier this month corporate climateers including Nike and 3M were given awards -- supposedly "the equivalent of an Oscar for the climate change mitigation world" -- for their efforts to reduce their carbon emissions. The honors were bestowed by the Carbon War Room, which "harnesses the power of entrepreneurs to implement market-driven solutions to climate change." The Virgin Group's Richard Branson is one of the nonprofit's co-founders.

Did SEIU Ballot Fraud Play Role in Harry Reid Re-Election?

Harry Reid photoVotes without voters - the notion seems like something from "The Twilight Zone." Yet this outcome, the result of a mysterious computer glitch, may have helped re-elect Senate Majority Leader Harry Reid over his Republican challenger, Sharron Angle, last week by a 50.2%-44.6% margin. Actually, the "mystery" is very likely the doing of a local of the Service Employees International Union (SEIU), which nationwide provides votes, money and muscle for the Democratic Party. Critics are charging that voting machines throughout Clark County (Las Vegas), where about three-fourths of Nevada's population resides, were rigged to place check marks next to Reid's name before a person even had voted. County officials insist that no tampering occurred. But the possibility can't be dismissed, especially given that one of Reid's sons is county commission chairman.

Why Government Shouldn't Block Home Foreclosures

foreclosure photoIf one word best summarizes the current housing market, "foreclosure" would be it. Despite record-low interest rates, American homeowners are losing their properties with greater frequency than at any time since the Great Depression. Yet banks and other financial institutions, until very recently on track to seize 1.2 million homes this year, are facing growing pressure to impose "voluntary" nationwide moratoria on foreclosure repossessions and sales. If they don't do the job themselves, say critics, government should do it. Several major lenders in fact have ceased property seizures in the wake of widespread revelations of foreclosures lacking proper documentation. The calls for action are understandable. Yet a moratorium, rather than restore integrity to our financial system, would further imperil it.

White House Ballyhoos Stimulus $ for Carnahan Wind Farm

Obama Carnahan photoIn response to the perception that much of the stimulus money has been spent on wasteful or unnecessary projects, the White House last week released a report titled "100 Recovery Act Projects That Are Changing America." It included $107 million for a wind farm in Missouri owned by Wind Capital Group (WCG), whose CEO is Tom Carnahan. His sister Robin (in photo) is the Democratic nominee for the Senate and his brother Russ is running for re-election to Congress.

When we commented on this appearance of cronyism back in May, we were under the impression that WCG qualified for a tax credit. It appears, however, that WCG will receive direct payments in lieu of tax credits for up to 30 percent of the cost of the wind farm.

Union-Backed Bill Would Force Monopoly Bargaining on Public Safety Employees

Mayor Bloomberg in Times Square bomber aftermathEver so quietly, America passed a milestone in 2009. For the first time in our history the number of employees in the public sector belonging to a labor union exceeded the number in the private sector. Proposed legislation in Congress would push this trend along further. The benignly-named Public Safety Employer-Employee Cooperation Act (H.R.413, S.1611) would mandate union monopoly bargaining for state and local public-safety employees. Its brand of "cooperation," strongly backed by the American Federation of State, County and Municipal Employees (AFSCME) and other unions, would force police, fire, ambulance, and corrections departments across the country to create collective bargaining units to cover employees. If evidence is any guide, however, this expansion of public-sector unionism is likely to produce higher taxes, strained budgets and more strikes.

Obama's 60-Vote Health Care Majority is Result of Fraud, Manipulation, Bribery

Obama/RiedWithout sixty votes in the Senate, Majority Leader Harry Reid (D-NV) would not be able to invoke cloture, or cut off debate. Anything short of sixty would allow a filibuster and doom Obama’s health care plan. The present 60-vote majority is artificial, the result of undemocratic means. Consider how three of these votes came to be:

Roland Burris- Appointed by Illinois Governor Rod Blagojevich just prior to his removal, Democratic leaders including Harry Reid pledged that he would never be seated. Barack Obama, along with other Democratic officials in Illinois, called for a special election to fill the seat. When it became apparent that a Republican could win, Obama and the others backed off from their request. Obama, Reid and the rest of the Democratic establishment eventually acquiesced to Burris’ appointment. The media was strangely uncritical of the sleaziest political deal of the decade.

American Cancer Society (Again) Endorses ObamaCare Despite Devastating Impact on Cancer Patients

ACS logoWe have criticized the American Cancer Society (ACS) for wading into the political fight over health care through its “advocacy affiliate,” the American Cancer Society Cancer Action Network (ACSCAN). In the clearest evidence yet that politics has replaced ACS’s core mission of fighting cancer, ACSCAN took part in a press conference this week to support “upcoming cloture votes on the Patient Protection and Affordable Care Act.”  In other words, ACSCAN wants the Reid bill backed by Barack Obama.

Now comes Senator Tom Coburn (R-OK), a practicing physician, with an op-ed in today’s Wall Street Journal that details just what ObamaCare might mean for cancer victims. He writes:

First-Time Homebuyer Tax Credit Program Rife with Fraud; IRS Employees in on Scam

IRS refundDespite its brief existence, the federal government's $8,000 tax credit for first-time homebuyers already has proven to be a costly boondoggle. And in what appears to be an act of unintended comedy, Congress is primed to extend and expand this "temporary" program beyond its November 30 deadline. On Thursday, October 22, J. Russell George, inspector general for the Internal Revenue Service, testified before a House Ways and Means subcommittee that the tax credit has been rife with inefficiency and fraud. Among those scamming the program, he believes, are more than 50 IRS employees. This interim report, George emphasized, if anything, understates the problem.
