Three Officers of UFCW Local in New York Charged in $2.4M Scam

UFCW logoUnited Food and Commercial Workers Local 348 in New York City for more than three decades has been a family affair - a Fazio family affair. And right now the family needs a good lawyer. On October 26, Anthony Fazio Sr., Anthony Fazio Jr. and John Fazio Jr. were arrested and charged in Manhattan federal court with racketeering, extortion, money-laundering and other offenses in connection with a scheme through which they stole about $2.4 million from local members and employers for more than a decade and a half. The defendants, respectively, the union's longtime past president, immediate past president and immediate past secretary-treasurer, kept the money or shared it with cronies. "As leaders of Local 348, the Fazios were supposed to advocate on behalf of their members, not strong-arm and threaten business owners in order to make a profit under the table," commented U.S. Attorney Preet Bharara.

UFCW District President in Pennsylvania Pleads Guilty to Theft

Food & Commercial Workers logoOn August 9, Ernest Milewski, former president of United Food and Commercial Workers, Northeast District Council, pleaded guilty in U.S. District Court for the Middle District of Pennsylvania to one count of embezzling union funds and one count of embezzling assets from a union-sponsored health care benefit program, each in an unspecified sum. Union Corruption Update reported on this case back in July. Milewski at the time had been charged with embezzling a combined more than $200,000 from the council, which is based in Wilkes-Barre, Pa., and its allied benefit fund. The charge and guilty plea follow a joint probe by the U.S. Labor Department's Office of Labor-Management Standards, Office of Inspector General, and Employee Benefits Security Administration.

UFCW Member in Maryland Sues Labor Department; Seeks Transparency

Labor Secretary Hilda SolisA union normally is about the last place anyone would look to find someone pressuring the U.S. Department of Labor (DOL) to more aggressively scrutinize union financial reporting. Yet a member of a public employee local in Maryland is doing just that. And he's gone to court, too. Meet Chris Mosquera, a member of Local 1994 of the United Food and Commercial Workers (UFCW), which represents municipal and county government workers in suburban Montgomery County, Md. This May, Mosquera filed suit in District of Columbia federal court against Labor Secretary Hilda Solis (see photo).

UFCW Official in Eastern Pennsylvania Charged with $200K+ Embezzlement

Ernest Milewski wasn't quite as clever as he imagined. The former president of the United Food and Commercial Workers (UFCW) Northeastern District Council was charged in U.S. District Court for the Middle District of Pennsylvania on July 11 with embezzling more than $200,000 from the Wilkes-Barre labor organization and an allied health care benefit program. The information count follows a joint investigation by the Labor Department's Office of Labor-Management Standards, Office of Inspector General, and Employee Benefits Security Administration. If convicted, he could face up to 15 years in prison.

Mississippi Food & Commercial Workers Local Official Pleads Guilty, Receives Sentence

Food and Commercial Workers logoOn April 8, Patsy Fontenot, former international representative for United Food and Commercial Workers Local 790C, was sentenced in U.S. District Court for the Southern District of Mississippi to one year of probation for embezzling $6,943.15 from the Lena, Miss.-based union during November 2002-March 2006. She also was ordered to pay a $1,000 fine and a $100 special assessment. Fontenot pled guilty on January 20. The guilty plea and sentencing follow an investigation by the Labor Department's Office of Labor-Management Standards.

On August 18, Patsy Fontenot, former International Representative for the United Food and Commercial Workers, was indicted in U.S. District Court for the Southern District of Mississippi on one count of embezzling $6,943.15 from UFCW Local 790C in Pearl, Miss. during November 2002-March 2006. The indictment follows a probe by the U.S. Labor Department's Office of Labor-Management Standards.

Mississippi Food and Commercial Workers Ex-Local Treasurer Pleads Guilty

UFCW Smithfield workersOn December 2, Dale Holifield, formerly financial secretary-treasurer of United Food and Commercial Workers Local 782C, pleaded guilty in U.S. District Court for the Southern District of Mississippi to one count of embezzling $7,468.19 from the Pearl, Miss.-based union. The guilty plea follows an investigation by the Labor Department's Office of Labor-Management Standards.
